95: News: Supreme Court calendars Vizconde case deliberations

MANILA, Philippines - The Supreme Court on Friday said it will deliberate on the Vizconde massacre case on November 23.

SC Spokesman and Court Administrator Jose Midas Marquez said the case was calendared for deliberations by the Court en banc for next Tuesday, November 16, which is the first session of the en banc after its recess.




Unfortunately, November 16 has been declared a holiday so the case will probably be discussed on November 23.

This is not the first time the Supreme Court en banc deliberates on the Vizconde case, but it will be the first time that the magistrates will tackle Hubert Webb's motion for acquittal.

Webb is among six individuals sentenced to life imprisonment by a Paranaque City Regional Trial Court for the rape and murder of Carmela and the murder of her mother, Estrellita, and sister, Anna Marie Jennifer, on June 30, 1991 at their residence in BF Homes, Paranaque.

The Court of Appeals affirmed the lower court's ruling before the case was elevated to the Supreme Court in 2007.

In his motion, Webb said he should be acquitted after the National Bureau of Investigation lost vital DNA specimens that could have proven his innocence.

Webb's motion for acquittal will be taken into consideration as the Court decides on the case based on existing evidence, minus the DNA testing and analysis requested by Webb
